Purpose
These Terms of Use (Terms) apply to www.kennagroup.com and other public Kenna websites that expressly link to these Terms (the Site). The Site is operated by KENNA, LLC (Kenna, we, us, or our). Please read these Terms before using the Site. By using the Site after being given notice of these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, please discontinue use of the Site.
About the Site
The Site provides information about Kenna, our creative work, branded merchandise, and related services. You may use it for lawful personal purposes and legitimate business purposes, including evaluating our services, viewing our work, and contacting us about a potential project.
These Terms govern website use. Client services and merchandise programs are governed by the applicable master services agreement, statement of work, order, or other agreement accepted by Kenna and the client. Those agreements control payment, production approvals, delivery, storage, returns, and other commercial terms. These Terms do not amend or replace them. Submitting an inquiry through the Site does not create a client relationship, place an order, or commit either party to a project.
Client portals and gift-redemption pages may have additional terms identified on those pages. Recipients do not assume a client’s payment or other commercial obligations simply by visiting a page or receiving a gift.
Ownership and permitted use
The Site and its content, including text, designs, photographs, videos, graphics, logos, and software, are owned by Kenna or used with permission from the relevant rights holders. They are protected by intellectual-property laws. Client names, trademarks, and project materials remain the property of their respective owners. Displaying them on the Site does not give visitors a license to use them or imply an endorsement beyond the relationship described.
You may browse the Site, share links to public pages, and download or print reasonable excerpts for personal reference or internal business evaluation. Keep copyright and other ownership notices intact. Except as expressly permitted here, authorized by the rights holder, or allowed by law, you may not reproduce, modify, sell, distribute, publicly display, or commercially exploit Site content. No ownership rights transfer to you through use of the Site.
Acceptable use
You must not use the Site to violate the law or another person’s rights; submit fraudulent, unlawful, threatening, or infringing material; impersonate another person or misrepresent your affiliation; send unsolicited advertising; or introduce malicious code.
You must not attempt unauthorized access to accounts, systems, or data; bypass security or access restrictions; or interfere with the Site or other users. Automated collection must not bypass access controls, impose an unreasonable load, or violate applicable law. Ordinary search-engine indexing is permitted subject to our published technical instructions. Nothing in these Terms restricts activity that applicable law does not permit us to restrict.
If a Site feature requires credentials, keep them secure and notify us promptly of suspected unauthorized access. Provide accurate information when communicating with us or using a Site feature.
Information you submit
When you send us an inquiry, brief, artwork, or other material, you retain your ownership rights. You confirm that you have the authority to provide it and permit us to use it as reasonably necessary to respond to your request, evaluate the opportunity, and carry out any separately agreed work. This permission does not authorize unrelated advertising, public display of your work, or use of your trademarks without your approval.
Please avoid submitting sensitive personal information or confidential project materials through a general inquiry form. Contact us first to arrange an appropriate way to share them. Any separate confidentiality agreement remains effective, and this provision does not waive rights or duties imposed by law. Personal information is handled as described in our Privacy Policy.
Privacy
Our Privacy Policy describes how we collect, use, and disclose personal information in connection with the Site and how to contact us about privacy questions. Website use does not replace any consent required by law or waive your privacy rights. Any privacy or data-processing commitments in a separate client agreement continue to apply to the information covered by that agreement.
Project examples and product information
Portfolio projects, product images, mockups, and descriptions illustrate our work and capabilities. They may show custom, past, or client-specific projects that are not available for purchase or reproduction. Colors and other visual details may appear differently depending on your device or display.
We aim to keep Site information accurate, but content may contain errors or become outdated. Product availability, specifications, pricing, and timelines must be confirmed in the applicable client agreement. Site content does not constitute a binding quotation, production approval, or guarantee of a particular result.
Third-party links
The Site may link to websites, platforms, or resources operated by others. Those services have their own terms and privacy practices. A link does not, by itself, mean we endorse or control the destination, and we are not responsible for independently operated third-party content. This provision does not release us from responsibility for obligations we undertake in a separate client agreement or for our own conduct.
Availability and changes
We may update, change, suspend, or discontinue public Site content or features, including for maintenance, security, or business reasons. We may restrict access where reasonably necessary to address misuse, unlawful activity, or a security risk. Changes to the public Site do not terminate or change our obligations under an existing client agreement.
We may revise these Terms and will update the date at the top of this page. Material changes will receive reasonably prominent notice on the Site or through another appropriate channel. Changes apply prospectively; they do not alter accrued rights or separately agreed client terms. Where applicable law requires express acceptance of a change, we will obtain it before treating the change as binding.
Website disclaimers
TO THE EXTENT PERMITTED BY LAW, THE SITE AND ITS INFORMATIONAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, ACCURATE, COMPLETE, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
These disclaimers concern the Site and its informational content. They do not disclaim express commitments concerning merchandise, client services, confidentiality, or data protection in a separate agreement, or rights and obligations that cannot lawfully be excluded.
Limitation of liability
TO THE EXTENT PERMITTED BY LAW, KENNA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF, OR INABILITY TO USE, THE PUBLIC SITE OR ITS INFORMATIONAL CONTENT.
This exclusion does not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not permit us to exclude. Claims concerning client services, merchandise, or obligations under a separate agreement are governed by that agreement, not this website limitation. These Terms do not limit statutory privacy rights or remedies. Some jurisdictions do not allow certain exclusions, so this provision applies only to the extent lawful in your circumstances.
Governing law
Washington law governs these Terms, without its conflict-of-laws rules, except where mandatory law requires otherwise. Subject to any nonwaivable right to bring a claim elsewhere, disputes relating solely to these Terms or public Site use may be brought in the state courts in Jefferson County, Washington, or, if federal subject-matter jurisdiction exists, the United States District Court for the Western District of Washington. You and Kenna consent to those courts. Disputes under a separate client agreement follow that agreement’s dispute provisions.
General terms and contact
These Terms address use of the Site and do not supersede separate client or confidentiality agreements. If a provision is unenforceable, it will be limited or removed to the extent necessary, and the remaining provisions will continue to apply. Our failure to enforce a provision is not a waiver of our right to enforce it later.
For questions about these Terms, suspected misuse, or intellectual-property concerns, contact legal@kennagroup.com. For an intellectual-property concern, please identify the material, its location on the Site, the rights involved, and your contact information so we can review it.
